These conditions regulate, on the one hand, the conditions of use, access and registration (the "Terms of Use") on the website www.superhealth-laboratories.com (the "Website"), by any person who accesses them (the "User" or "Users"), as well as the conditions of purchase of the products offered on the Website (the "Purchase Conditions"). Hereinafter, the Terms of Use and the Purchase Conditions may be referred to jointly as the "Conditions".
In compliance with the information duty set forth in article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the following data of the owner are reflected below:

By accepting these Terms of Use, the User expressly agrees to be bound in their full extent and scope, without exception to any of their provisions. SUPERHEALTH reserves the unilateral right to modify the Terms of Use included in this document.
The User may navigate and view the content, as well as the products offered on the Website, freely and at no cost. Access to the Website is free for its Users.
The User may request the acquisition of products on the Website through the corresponding form.
By navigating, using or viewing the contents of the Website, the User declares that they are over eighteen (18) years of age or, failing that, that they have the proper authorization from their legal guardians.
SUPERHEALTH reserves the right to modify, suspend, cancel or restrict the content or services of the Website, its links and the information obtained through it, without prior notice.
It is not permitted and, therefore, its consequences will be the exclusive responsibility of the User, access or use of the Website for illegal or unauthorized purposes, with or without profit motive. In particular, and without the following list being exhaustive, the following is prohibited:
(i) Use the Website in ways that are contrary to the Law, morality, public order or generally accepted good customs;
(ii) Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in the computer equipment of a third party;
(iii) Use the Website for the transmission, installation or publication of any virus, malicious code or other harmful programs or files;
(iv) Use the Website to collect personal data from other Users;
(v) Use the Website illegally, against good faith, morality and public order;
(vi) Register through the Website with a false identity, impersonating third parties or using a profile or performing any other action that may confuse other Users about the identity of the User;
(vii) Access without authorization any section of the Website, other systems or networks connected to them, SUPERHEALTH servers or services offered through the Website by means of hacking or counterfeiting, password extraction or any other illegitimate means;
(viii) Break or attempt to break the security or authentication measures of the Website or any network connected to them, or the security or protection measures inherent to the contents offered on the Website;
(ix) Carry out any action that causes disproportionate or unnecessary saturation in the Website infrastructure, SUPERHEALTH systems or networks, as well as systems and networks connected to the Website;
(ix) Prevent the normal development of a service, promotion or any other activity available through the Website or any of its functionalities, whether by altering or trying to alter, illegally or in any other way, access to or operation of them, or by falsifying their result and/or using fraudulent participation methods, through any procedure and/or through any practice that attacks or violates these Terms of Use.
User status is attributed to any person who navigates and views the content offered on the Website indefinitely.
Registered Users through the registration form will have access and will be able to use the private area on the Website free of charge.
It is a requirement to be able to register as a User to have provided all the required and catalogued data as mandatory, which may be provided by the User by pressing the "Create account" button.
Once the necessary and catalogued data as mandatory have been correctly provided, the User will be able to create and access a private area.
Access to the Website and subsequent completion of the registration form implies the application of the conditions of treatment of your personal data described in the Privacy Policy, which must be previously accepted by the User.
Once inside the private area, the User may access the necessary information to purchase products through the Website, as well as review the status of their orders, track their shipment, customize their subscription and purchase additional products. Without prejudice to the foregoing, the purchase of products offered on the Website will also be possible without the need to register.
The User assumes that the password and user account are personal and non-transferable.
The User may modify their password at any time, using the tools made available by SUPERHEALTH.
The User undertakes to make diligent use of their password and keep it secret, not being able to transmit it to any third party. Consequently, Users will be responsible for the proper custody and confidentiality of any identifiers and/or passwords they have selected as registered Users, and undertake not to transfer their use to third parties, whether temporary or permanent, nor allow third parties to access their account. The User will be responsible for the illicit use of their account, responding for any damage generated by a third party who accesses it using their access credentials.
By virtue of the foregoing, it is the User's obligation to immediately notify SUPERHEALTH about any fact that allows the improper use of identifiers and/or passwords, such as theft, loss or unauthorized access to them, in order to proceed to their immediate cancellation. As long as such facts are not communicated, SUPERHEALTH will be exempt from any responsibility that could derive from the improper use of identifiers or passwords by unauthorized third parties.
Access as a registered User will begin once the required data for registration has been entered, after acceptance of the Privacy Policy and these Terms of Use.
Access as a User will remain in force indefinitely until they notify SUPERHEALTH of their unsubscription as a User to the following email: support@superhealth-laboratories.com
Once access to the private area is obtained, the User will be able to view and have access to certain contents offered by SUPERHEALTH, which allow:
(i) Access subscription data and modify it;
(ii) Access order history;
(iii) Modify contact data;
(iv) Modify password;
(v) Get help from our frequently asked questions.
The User acknowledges and accepts that SUPERHEALTH is the exclusive owner of the intellectual property, industrial or any other rights relating to the Website. This includes, among others, the rights of reproduction, distribution, public communication, making available and transformation over the Website and any of its elements, including source code, object code, technical documentation, user manual, etc., as well as any other related or derived element.
By accepting these Terms of Use, it shall not be understood that any intellectual property, industrial or any other right relating to the Website is assigned in favor of the User, beyond the right to use them under the terms established herein.
In accordance with the foregoing, the User undertakes to:
(i) Not duplicate, reproduce, sell, rent, lease, license, distribute or, in any other way, use the Website software for a use other than that expressly authorized in these Terms of Use;
(ii) Not decompile, modify, reformat, translate, reverse engineer, disassemble or access in any other way the source code of the website software without prejudice to applicable legislation expressly permitting such activities regardless of the existence of a pact or authorization to the contrary with the User;
(iii) Not alter or delete any notices relating to intellectual property, industrial or any other rights that were included in the software;
(iv) Not alter or delete any notices relating to intellectual property, industrial or any other rights that were included in the software;
(v) Not violate the intellectual property, industrial or any other rights that SUPERHEALTH holds over the Website;
(vi) Not develop computer programs, applications or computer products of any other kind that fulfill a function similar to that of the private area of the Website, provided that such development is based on SUPERHEALTH intellectual property assets or knowledge acquired as a result of the contractual relationship existing with the User;
(vii) Not register trademarks, trade names or any other distinctive sign associated with or that could be associated with the Website.
In order to allow SUPERHEALTH to effectively control and defend its intellectual property rights, SUPERHEALTH may collect information, as well as any other data that is pertinent to verify the effective use of the Website.
In this regard, the User expressly authorizes SUPERHEALTH to use the information collected during the use of the Website as effective evidence of its use in any type of cause and proceeding of any nature, whether this is against the User themselves or against any third party.
In case links to other websites are shown on the Website through different buttons, links, banners or embedded content, SUPERHEALTH informs that these are managed by third parties, with SUPERHEALTH having neither human nor technical means to know in advance and/or control and/or approve all the information, content, products or services provided by other platforms to which links may be established from the Website.
Consequently, SUPERHEALTH cannot assume any responsibility for any aspect relating to the website to which a link could be established from the Website, specifically, and by way of example but not limitation, regarding its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
In this regard, if Users had effective knowledge that the activities developed through these third-party websites are illegal or contravene morality and/or public order, they must immediately communicate it to SUPERHEALTH so that the access link to them can be disabled, an action that will be carried out in the shortest possible time.
In any case, the establishment of any type of link from the Website to another external website will not imply that there is any type of relationship, collaboration or dependence between SUPERHEALTH and the owner of said external website.
The User exonerates SUPERHEALTH from any responsibility that could derive from availability interruptions or operating errors of the Website, due to failures in it.
Likewise, SUPERHEALTH will not have the duty to control the use of content or services, their identity or the accuracy or veracity of data or information provided by Users, beyond legally established obligations.
SUPERHEALTH has the right to discretionally deny any User access to this Website if there are indications of use thereof against these Terms and Conditions of Use.
The limitation of access may be carried out without the need for prior warning and without SUPERHEALTH assuming any responsibility for such decision.
Non-compliance with any of the above obligations by the User may lead to the adoption by SUPERHEALTH of appropriate measures protected by Law and in the exercise of their rights or obligations, and may lead to the elimination or blocking of the offending User's account, without there being any possibility of compensation for damages caused.
SUPERHEALTH reserves the possibility of altering, modifying or suspending any feature of the Website.
SUPERHEALTH does not guarantee the lawfulness, reliability or usefulness of content supplied by third parties through the Website. If the User had knowledge of the existence of any illicit, illegal content, contrary to laws or that could constitute an infringement of third party rights, they must immediately notify SUPERHEALTH so that it can proceed to adopt appropriate measures.
In accordance with the provisions of Regulation 2016/679 of the European Parliament and of the Council, of April 27, 2016, relating to the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights, all personal data collected during the use of the Website will be processed in accordance with the provisions of the Privacy Policy, which every User must expressly accept in case of providing personal data through the private area of the Website.
SUPERHEALTH makes available to the User the following email: support@superhealth-laboratories.com, in order to provide support and help, as well as to receive any comments or concerns from the User, both during the service contracting procedures and afterwards.
In addition, it should be remembered that the User has SUPERHEALTH's contact data reflected in section 1 of these Conditions.
The headings of the different clauses are for informational purposes only and will not affect, qualify or expand the interpretation of these Terms of Use. Likewise, SUPERHEALTH may modify the Terms of Use stipulated herein, totally or partially, by publishing any change in the same way these Conditions appear or through any type of communication directed to Users.
The temporal validity of these Terms of Use coincides, therefore, with the time of their exposure, until they are modified totally or partially, at which time the new modified Terms of Use will come into force.
SUPERHEALTH may terminate, suspend or interrupt, at any time and without prior notice, access to the Website contents, without the possibility for the User to demand any compensation. After such termination, the prohibitions on use of contents set forth previously in these Terms of Use will remain in force.
In the event that any provision of these Terms of Use were declared null or inapplicable, in whole or in part, by any competent Court, Tribunal or administrative body, such nullity will not affect the remaining provisions of the Terms of Use.
The non-exercise or execution by SUPERHEALTH of any right or provision contained in these Terms of Use will not constitute a waiver thereof, except express recognition and agreement in writing on their part.
These Terms of Use will be kept in electronic format by SUPERHEALTH and will remain permanently available to the User.
The User and SUPERHEALTH will formalize the contract in Spanish, this being the language of interpretation of these Terms of Use.
If after carrying out all the necessary procedures to navigate and access the Website and perfect these Terms of Use, the User identifies any error when entering their data, they must contact SUPERHEALTH through the email address support@superhealth-laboratories.com. SUPERHEALTH will provide the necessary support and correct, where appropriate, the errors identified.
Except for contrary provision in these Terms of Use, notifications between the User and SUPERHEALTH must be made in writing by email to the corresponding email addresses. For these purposes, SUPERHEALTH's contact data will be those that appear in these Terms of Use and the User's contact data will be those established on the Website.
These Purchase Conditions regulate the acquisition by any User of the products offered on the Website, consisting of natural solutions based on nutritional formulas with different benefits (the "Products"), as well as other accessory products to use said solutions or promotional or merchandising material from SUPERHEALTH (the "Accessories").
Before making the purchase of the Products and/or Accessories offered on the Website, the User is obliged to read and accept these Conditions. Through said acceptance, the User expressly agrees to be bound in their full extent and scope, without exception to any of their provisions.
SUPERHEALTH reserves the unilateral right to modify these Purchase Conditions. Therefore, it is the User's responsibility to periodically read the current conditions that are applicable to them and, in any case, before making a transaction through the Website. Without prejudice to the foregoing, SUPERHEALTH will notify Users of any change considered substantial thirty (30) days in advance of its entry into force.
It is mandatory that the User who uses, accesses, navigates and/or purchases the Products and/or Accessories offered on the Website, be of legal age or, failing that, have the corresponding authorization from their legal guardians.
The User may access the Website and view, freely and at no cost, the Products and Accessories available for purchase, as well as the price and a brief description of them, including their essential characteristics.
The temporal validity of these Purchase Conditions coincides with the time of their exposure, until they are modified totally or partially, at which time the new modified Purchase Conditions will come into force.
To be able to make the purchase of one or more Products and/or Accessories, it will not be necessary for the User to register mandatorily on the Website, although they will not have access to additional functionalities that will only appear in the private area of registered Users.
To register on the Website, once the necessary and catalogued data as mandatory have been correctly provided, the User, by pressing the "Create account" button of the form, will be able to create and access a personalized private area.
To be able to make the purchase of the Products and/or Accessories offered through the Website, the User must choose those they wish to acquire in order to view the total purchase price ("Final Price").
Once the Final Price is displayed, if the User wishes to proceed with the purchase of the selected Products and/or Accessories, they must pay said Final Price at the time of ordering, by payment with bank card through the payment gateway provided, as well as through Google Pay or Apple Pay or shop.
SUPERHEALTH will send a purchase confirmation to the email address provided by the User, of which SUPERHEALTH advises the User to keep a copy. SUPERHEALTH reserves the right to suspend any order in case the payment method used by the User is rejected by the competent bodies.
The data entered by the User must be true, with SUPERHEALTH being free of responsibility in cases where the User, either voluntarily or involuntarily, enters data that does not correspond to reality.
The User, once payment is made, will receive the invoice in electronic format at the email address they have provided with the corresponding form.
Users who so wish will also have the possibility of making a recurring purchase of any of the Products, instead of a one-time purchase. In this way, the User will receive the selected Product on a recurring and automatic basis each month. Said recurring purchase will have a minimum permanence of three (3) months, after which the User may unsubscribe by contacting SUPERHEALTH directly.
By selecting the recurring purchase of any of the Products, the User obtains free shipping of the same and, in addition, Users are offered an exclusive gifts, which will contain a SUPERHEALTH accessory.
Product deliveries will be made, as a general rule, within forty-eight (48) to seventy-two (72) hours from the moment of order confirmation by SUPERHEALTH if they are deliveries to the peninsula. For shipments to the Balearic Islands and the Canary Islands, deliveries will be made within three (3) to (5) business days from the moment of order confirmation by SUPERHEALTH. International deliveries will depend on the country of delivery. At the time of making the purchase and selecting the shipping method, SUPERHEALTH will inform the User of the approximate shipping time, which will be three (3) to five (5) business days for the European Union and seven (7) to twelve (12) business days for countries outside the European Union.
The User will know the Final Price of the Products purchased prior to payment of the corresponding price. The Final Price will include VAT in all cases and will be expressed in Euros.
Products will be invoiced at the Final Price in effect at the time of order, except for promotions and/or campaigns. SUPERHEALTH reserves the right to apply discounts to the Final Price.
In any case, the User will be shown the Final Price at the time the purchase is to be made effective (time of payment), in accordance with the provisions of these Purchase Conditions, of which the User will receive a copy upon order confirmation.
The User will have a period of fourteen (14) days to exercise the right of withdrawal regarding the acquisition of Products and/or Accessories as long as the articles are maintained in the same state in which they were delivered, having to preserve their packaging and labeling until SUPERHEALTH recovers them or the User sends them back.
In any case, in order to exercise their right of withdrawal if it were applicable, the User must contact SUPERHEALTH via email, communicating their identifying data and the order reference number.
In case of cancellations, the amounts previously paid by the User will be refunded through the same means used for the initial transaction, deducting, where appropriate, the costs associated with shipping the Product or Products to be returned.
If the User considers that any of their rights has been violated, SUPERHEALTH proposes that they communicate it, through any of the following channels, and commits to respond and address their concerns in relation to the alleged infringement of rights:

Once all information is received, SUPERHEALTH may take the necessary measures in order to investigate and resolve the situation.
In no case will the implementation of any measure mean the admission by SUPERHEALTH of any responsibility. SUPERHEALTH reserves the exercise of any right, action or defense that assists them.
The sale is understood to be carried out in Spanish territory, so for any interpretive or litigious issues that may arise, Spanish legislation will apply and, in case of controversy, both parties agree to submit, waiving any other jurisdiction that may correspond to them, to the jurisdiction of Courts and Tribunals of the consumer's domicile.
Likewise, by virtue of the provisions of Regulation (EU) No. 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution in consumer matters, in case of any controversy related to these Conditions, the User may go to the "Online Conflict Resolution Platform" that the European Commission has developed through the following link: http://ec.europa.eu/consumers/odr/
